A Lawyer’s Role In Home Purchases

It is very important to have an experienced lawyer when executing a transaction as important and as large as the purchase of your home.

The lawyer’s role is to protect the interests and rights of the buyer in accordance with the terms of the Agreement of Purchase and Sale, to ensure the buyer is getting good and clear title to the property and to ensure a smooth transfer from seller to buyer.

It is a good idea to call a few experienced lawyers to find the right one for you and to inquire about fees.  Legal fees vary according to every lawyer but most will charge a flat fee.  What does that fee include? Does it include registering your mortgage? Does it include a title search?

Some lawyer’s will also charge a separate fee for disbursements. These are fees that may include tax certificates, deed registrations and miscellaneous fees for items such as postage and photocopies.

Be prudent and clarify all these fees and amounts prior to choosing the right lawyer for you.
